1. Relationship and Service
These Terms and Conditions ("Terms") govern your relationship with the https://www.rofaiva.co.nz website (the "Service") operated by Ro Faiva Limited. The Service includes the primary Ro Faiva Art store and the Ar.Ti streetwear apparel and accessories store (collectively referred to as "the Stores"). By using the Service, you agree that Ro Faiva Limited trades under both the "Ro Faiva" and "Ar.Ti" brands.
2. Purchases and Third-Party Fulfilment
If you wish to purchase any product made available through the Service ("Purchase"), you may be asked to supply information relevant to your Purchase.

Shared Cart: You acknowledge that the Service operates a single checkout for both Ro Faiva Art and Ar.Ti. Items from both brands may be purchased in a single transaction.

Print-on-Demand (POD): You acknowledge that products sold under the Ar.Ti brand (including streetwear, accessories, glass cups, and stainless steel mugs) are manufactured and fulfilled by third-party partners, specifically Printful.
3. Shipping and Delivery

Multiple Shipments: Because Ar.Ti products are fulfilled via a POD model, orders containing items from both Ro Faiva Art and Ar.Ti may arrive in separate packages and at different times.

Shipping Rates: Shipping is calculated at checkout based on the fulfilment origin. Ro Faiva is not responsible for delays caused by third-party carriers or customs processing for international orders as outlined under the NZ Consumer Guarantees Act.
4. Availability, Errors, and Product Variations
We constantly update our offerings. For Ar.Ti POD products, you acknowledge that:

Product images are digital mockups for illustration purposes.

Actual colors and print placement may vary slightly due to the printing process on different materials (e.g., fabric vs. stainless steel).

We reserve the right to change or update information and correct errors at any time without prior notice.
5. Returns and Refunds
Our return policy differs depending on the product type:

Ar.Ti (POD) Products: As these items are custom-made to order, we do not generally offer returns for "change of mind" or incorrect size selection. Returns are only accepted for damaged or defective items. Claims for misprinted/damaged/defective items must be submitted within 4 weeks after the product has been received.

Lost Packages: For Ar.Ti items, claims for packages lost in transit must be submitted no later than 4 weeks after the estimated delivery date.
6. Intellectual Property
The Service and its original content, including designs for Ro Faiva and Ar.Ti, are the exclusive property of Ro Faiva Limited and its licensors. You may not use our trademarks or trade dress without prior written consent.
7. Limitation Of Liability
In addition to previous limitations, Ro Faiva Limited shall not be liable for any delays or failures in performance resulting from acts beyond our control, including the manufacturing delays of third-party POD providers.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of New Zealand.
9. AI-Generated Content and Virtual Models

Synthetic Imagery: You acknowledge that some product images, promotional materials, and lifestyle photos featuring human models on the Service are generated using Artificial Intelligence (AI) technologies. These models are synthetic, computer-generated personas and do not represent real individuals.

No Affiliation: Any resemblance between an AI-generated model and a real person, living or dead, is purely coincidental. Ro Faiva Limited does not claim any endorsement by, or affiliation with, any real person depicted via AI-generated imagery.

Liability Release: To the maximum extent permitted by New Zealand law, Ro Faiva Limited shall not be liable for any claims arising from the perceived likeness of AI-generated content to any real person or protected intellectual property.
